This Privacy Policy governs the manner in which Quicksilver Scientific, Inc. and our subsidiaries ("Quicksilver," "we," or "us") collect, use, maintain, and disclose information collected from users (each, a “User” or "you") in connection with your use of the Site and products you order (the "Services"), including on behalf of our family of brands (Quicksilver Scientific®, Naba™). This Privacy Policy applies to the information we collect:

  • Information collected on our websites from which we link to this Policy, including https://www.quicksilverscientific.com/ and https://naba.com (the “Site”).

  • In email, text, and other electronic messages between you and Quicksilver.

  • Offline, such as through telephone support calls.

This Privacy Policy does not apply to:

  • Information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Site.

  • Third party websites that are linked through our Site. We do not control the content or practices that appear on these sites and are not responsible for websites linked to or from our Site.

Please read this Privacy Policy carefully to understand our policies and practices regarding your Personal Information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Services. By accessing or using our Services, you agree to this Privacy Policy and the Terms and Conditions. This Privacy Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of our Services after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates.

INFORMATION WE COLLECT

We collect several types of information from and about users of our Services, including information:

  • By which you may be personally identified, such as name, postal address, e-mail address, telephone number, or any other identifier by that could reasonably be linked, directly or indirectly, to you as an individual ("Personal Information");

  • That is about you but individually does not identify you; and/or

  • About your internet connection, the equipment you use to access our Services, and usage details.

The Personal Information we collect about you may include the following categories:

  • Identifiers: name, address, unique personal identifier, online identifier, IP address, email address, account name, or other similar identifiers.

  • Personal Information described in the California Customer Records Statute (Cal. Civ. Code § 1798.80): name, address, telephone number, education, credit card number, debit card number.

  • Characteristics of protected classifications under California or federal law.

  • Commercial Information: products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

  • Internet / Network Activity: browsing history, search history, and information regarding a consumer’s interaction with an internet website application, or advertisement.

METHODS OF COLLECTION 

We collect this information:

  • Directly from you when you provide it to us.

  • Automatically as you navigate through the Site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.  Some of these technologies collect information about your online activities over time and across our Site and third-party websites or other online services. See the Choices section for information on how you can opt out of this automated collection.

  • From third parties, that include:

    • Digital marketing providers: This may include social media and other online advertising/marketing providers, brand managers, marketing brokers, digital advertising publishers, and similar vendors.

    • Partners and delivery carries: This includes our partners that you may order our products from and the services providers we utilize to fulfill orders of your goods and products.

  • The website uses cookies to help keep track of items you put into your shopping cart including when you have abandoned your cart and this information is used to determine when to send cart reminder messages via SMS.

HOW WE USE COLLECTED INFORMATION

We may use all the categories of Personal Information disclosed in the "Information We Collect" section for the following business purposes:

  • Product Service and Fulfillment:

    • Fulfilling orders from the Site where we process payments and ship your goods.

    • Communicating with you on the status of your orders via SMS (when you opt-in) and email.

    • Sending you information you agreed to receive about topics we think will be of interest to them.

    • Running a promotion, contest, survey or other Site feature.

  • Enhancing Your Experience with Us:

    • Improving customer service, including responding to your customer service requests and support needs. 

    • Personalizing the user experience, including identifying website visits, ad interaction, and search history; recommending products based on your preferences; and tailoring your experience on our Site.

    • Conducting, managing, maintaining, and improving our products and Services.

    • Managing business operations and processes.

    • Carrying out security and privacy practices, which may include, but not be limited to detecting, investigating, and resolving potential vulnerabilities, data security, or privacy incidents.

    • Maintaining systems, networks, applications, and databases, which may include, but not be limited to preventing, finding, and resolving software, hardware, or application bugs and issues.

  • Our Marketing Purposes

    • Determining what products and services you may be interested in.

    • Marketing products and services to you online and via SMS (when you opt-in) and email.

    • Enhancing our marketing to you by through data analytics, optimizing online searching, and identifying product interest. 

    • Sending communications to you via our mailing list if you have opted-in. 

  • Legal and regulatory compliance

    • Complying with applicable laws, regulations, and oversight obligations, including but not limited to quality assurance and internal and external audits and investigations.

    • Engaging with law enforcement and other governmental bodies.

    • Enforcing our legal rights and remedies. 

All Personal Information listed above is retained as long as necessary to achieve the purpose for which the data was collected.

HOW WE DISCLOSE YOUR PERSONAL INFORMATION

We may disclose aggregated information about our Users, and information that does not constitute Personal Information, without restriction.

We may disclose all categories of Personal Information listed in the "Information We Collect" section to the following parties:

  • To contractors, service providers, and other third parties we use to support our business purposes, described in the "How We Use Collected Information" section.

  • To digital marketing providers that may social media and other online advertising/marketing providers, brand managers, marketing brokers, digital advertising publishers, and similar vendors.

  • To a buyer or other successor in the event of a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Quicksilvers assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.

We may also disclose your Personal Information to third parties under the following circumstances:

  • With your consent.

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce or apply our Terms and Conditions and other agreements, including for billing and collection purposes.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Quicksilver, our customers, or others. 

HOW WE SHARE YOUR PERSONAL INFORMATION

In connection with our marketing purposes described in the "How We Use Your Information" section we may "sell" or "share" some of your Personal Information within the broad definitions adopted under certain state laws.  Personal Information that is shared in this manner may include Identifiers (online identifier, IP address), Commercial Information (products or services purchased, obtained, or considered), or Internet / Network Activity (browsing history, search history, and Site interactions).  See the "Choices" Section for information on how you can limit this disclosure.

CHOICES

Quicksilver offers you the following choices with respect to how your Personal Information is used.

  • Web Browser Cookies and Tracking Technologies

    • On our site, cookies are in two categories – Strictly Necessary Cookies and Other Cookies. Strictly Necessary cookies are necessary for the website to function and cannot be switched off in our systems. Other Cookies are performance and/or targeting cookies that collect information for analytics and to personalize your experience with targeted ads. To learn more or to turn off the performance and targeting cookies, please visit "Your Privacy Rights". Additionally, Users may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If you do so, note that some parts of the Site may not function properly.

  • Text Notifications

    • Text Messaging

      • After you have provided your mobile number and opted-in , you consent to receive recurring automated text messages (SMS, MMS, and RCS) from us at the number you provided. These may include:

        • Notifications related to your orders, and / or

        • Marketing messages

      • Your consent to receive text messages is not a condition of any purchase.

      • If at any time you would like to unsubscribe from text messages you may reply "STOP" to the communication.

      • If at any time you need assistance with the text messages reply "HELP" to the communication, or by reaching out to us as described in the "Contact Us" section.

      • Message frequency of text messages varies.

      • Email Marketing

      • If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or you may contact us as described in the "Contact Us" section.

    • Third Party Advertising

      • Google Adsense: Some of the ads may be served by Google. Google’s use of the DART cookie enables it to serve ads to Users based on their visit to our Site and other sites on the Internet. You may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy at http://www.google.com/privacy_ads.html

      • We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

    YOUR DATA RIGHTS

    Depending on where you reside, you may have additional rights with respect to your Personal Information, which include:

    • Right to Know and Portability

      • You have the right to know what Personal Information we have collected about you, how we have used your Personal Information, and the categories of parties with whom we have shared the Personal Information within the last 12 months. We will share the Personal Information collected about you in a portable, and to the extent technically feasible, readily usable format. 

    • Right to Delete 

    • You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions, such as completing a transaction you have requested, detecting security incidents, and complying with legal obligations, among other exceptions. We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action. 

    • Right to Correct

      • You have the right to correct Personal Information about you that we have that is incorrect. Upon verification of the contested Personal Information, we will correct or delete the incorrect Personal Information.

    • Right to Opt-Out of Sale

      • You may opt-out of the sale or sharing of your Personal Data to third parties, by updating your preferences at Your Privacy Rights or by calling us at 303-531-0861.

      • You may also use certain preferences signals to opt-out automatically with all businesses that you interact with online, including our Site. If you enable one of these browser-based preference signals, then upon receipt or detection, we will endeavor to recognize and treat the signal as a valid request to opt out. If you use different browsers or profiles, you may need to enable the preference signal in connection with each browser and profile for us to associate the signal with you.  Additionally, if you delete or reset your browser settings you may need re-enable your opt-out preference signal. 

    Exercising Your Rights to Know, Delete, or Correct

    To exercise your rights to know, delete described above, please submit a request by either: 

    Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. To designate an authorized agent if you are a California resident, the agent must be a natural person or a business entity that is registered with the California Secretary of State.

    If you would like to designate an agent to act on your behalf, you and the agent will be required to provide us with proof of the agent’s identity and proof that you gave the agent signed permission to submit a request on your behalf. Additionally, you will be required to verify your identity by providing us with certain Personal Information as described above or provide us with written confirmation that you have authorized the agent to act on your behalf.

    Please note that this subsection does not apply when an agent is authorized to act on your behalf pursuant to a valid power of attorney. Any such requests will be processed in accordance with respective state law pertaining to powers of attorney.

    You may only submit a request to know twice within a 12-month period. Your request to know or delete must:

    • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative, which may include:

      • Our verification of your full legal name, home address, and last two purchases.

    • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

    We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. 

    You do not need to create an account with us to submit a request to know, delete, or correct. 

    We will only use Personal Information provided in the request to verify the requestor's identity or authority to make it. 

    Response Timing and Format

    We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at privacy@quicksilverscientific.com.

    We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

    If you have an account with us, we will deliver our written response to that account.  If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. 

    Any disclosures we provide will only cover the 12-month period preceding our receipt of your request.   The response we provide will also explain the reasons we cannot comply with a request, if applicable.  For data portability requests, we will select a format to provide your personal information that to the extent technically feasible, is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

    We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. 

    Non-Discrimination

    We will not discriminate against you for exercising any of your data rights. Unless permitted by applicable state law, we will not:

    • Deny you goods or services.

    • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

    • Provide you a different level or quality of goods or services.

    • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

    HOW WE PROTECT YOUR INFORMATION

    We have implemented reasonable technical, administrative, and physical security measures on this Site designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. However, the transmission of information via the internet is not completely secure. The safety and security of your information also depends on you taking appropriate precautions to protect yourself while on the internet and we do not guarantee or warrant the security of your Personal Information transmitted to our Site. Any transmission of Personal Information is at your own risk and we are not responsible for your circumvention of any privacy settings or security measures contained on the Site.

    CHILDREN UNDER THE AGE OF 16

    Our Website is not intended for children under 16 years of age. No one under age 16 may provide any information to or on the Site. We do not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information on the Site or on or through any of its features. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 16, please contact at the information in the "Contact Us" section. 

    YOUR ACCEPTANCE OF THESE TERMS; CHANGES TO OUR PRIVACY POLICY

    By using this Site, you signify your acceptance of this Privacy Policy and the Site’s respective Terms and Conditions. It is our policy to post any changes we make to our Privacy Policy on this page. The date the Privacy Policy was last revised is identified at the top of the page.
